Artist Terms & conditions
These Artist Terms and Conditions form a legally binding agreement between You, the artist, and Arteq Ltd, company number 6194353, the supplier of the Service. Your statutory rights are not affected.
Acceptance
By accepting these terms you agree to ensure that all information supplied to Arteq is accurate, and up to date. You also agree to have Your Artwork and its associated descriptive information displayed on Arteq. You will inform Arteq Ltd of any changes in the information stored by Arteq including your name, your address and contact details, pricing of Artwork, and the Sold status of Artwork. Arteq Ltd reserves the right to accept or decline Your application to sell and market your Artwork through Arteq and the Arteq Gallery. Your application includes your acceptance of these Artist Terms and Conditions. Arteq Ltd reserves the right to accept or decline Your application to market any Artwork through Arteq.Uploaded Images
You must supply two good-quality digital Images of each Artwork you wish to sell through Arteq: a Full-size Image and a Close-up Image. The Images must be in JPEG format. The Full-size Image will show the entire canvas and frame (if framed). The minimum pixel width of the Full-size image will be (18.75 * width of the Artwork in inches). E.g. if the Artwork is 18 inches wide, the minimum width of the Full-size Image is 337.5 pixels. The Close-up Image will show a portion of the Artwork to illustrate the grain of the canvas. The width of the Close-up Image will be no more than 500 pixels.Selling Artwork through other outlets or companies
You may market your Artwork through other avenues simultaneously with marketing through Arteq, providing this does not affect Your ability to deliver the Artwork to the Customer within the specified time. You must inform Arteq immediately if the Artwork is sold through another channel so that We may remove it from Arteq - if you fail to notify Arteq that Your artwork has been sold through another channel and your art is subsequently sold by Arteq You will be charged a flat fee of 50.Delivery and packaging
You are responsible and liable for costs of all materials, packaging and delivery costs. These costs cannot be reclaimed from Arteq Ltd and should be taken into account when pricing Your Artworks. You will ensure that Artworks are securely packaged and labelled for delivery to the Customer. Arteq Ltd will not accept claims for reimbursement in the event of damage to Artworks through insufficient packaging or carelessness of couriers used. You will not include any contact details that would enable the customer to deal directly with you in the packaging. If You are found to have breeched this condition you will be charged a flat fee of 50.You will package and arrange delivery of Artworks to the Customer within 5 days of receiving the order. The Artwork must arrive with the Customer no later than 5 working days after the order has been received by You. Should You become aware of any reason why an Artwork that has been ordered from You may not be received by the Customer within 5 days, you will notify Arteq immediately of the reason for and expected length of the delay. Arteq Ltd will attempt to contact the customer and in some cases may offer a refund to the Customer resulting in the cancellation of the order from You.
Pricing
Along with the Images of the Artwork you will supply the price which the Artwork should be sold for. This price must be inclusive of VAT (if applicable) and your delivery costs and Arteq Ltd's commission of 20%. Once accepted You agree to sell the artwork at the accepted price. You may not raise the price of an Artwork without the express written permission of Arteq Ltd.Payment
Should Your Artwork(s) be sold We will raise a purchase invoice for the Price. The Invoice will be paid by Arteq Ltd no sooner than 14 days after Arteq have confirmed delivery of the Artwork(s) to the Customer. Payment will be made by cheque or bank transfer. You will not include contact details that would enable the customer to deal directly with you. You will not correspond directly with the Customer. If You are found to have breeched this condition you will be charged a flat fee of 50. In the event of a refund claim we will release your name and address details to the Customer for them to return the Artworks to you.14 Day Money back guarantee
You accept that the Customer may return the Artwork(s) within 14 days of receipt, and this will constitute cancellation of the order. Arteq will not accept liability for Your delivery expenses in this instance. All correspondence with the Customer regarding returns and refunds will be through Arteq, not through You.Copyright
You warrant that all work sold through the Site is free of any copyright restrictions or intellectual property disputes. You warrant the Work is yours to sell. The copyright of the Artwork will remain with you even after ownership of the Artwork is transferred to the Customer.Ownership of Customer relationship
You agree that the business relationship between the Customer and Arteq is entirely owned by Arteq. You will not approach the Customer directly or correspond with the Customer in any way, except with express written authorisation from Arteq. You will not sell directly to the Customer or allow a direct relationship to develop between You and the Customer that could be detrimental to Arteq. You will not pass Your contact details to the Customer, including in Artwork packaging. All correspondence with the Customer shall take place through Arteq, not through You. In the event of a return or damaged goods claim, we will release Your name and address details to the Customer.Disclaimer
You agree to defend, indemnify, and hold harmless Arteq Ltd, its officers, directors, employees, agents, and third parties, from your use of the service, including any violation of these rules. Arteq Ltd provides this service on an "as-is" basis without warranty of any kind including the implied warranties of merchantability and fitness for a particular purpose.This Agreement is entered into in England and shall be governed by, and shall be construed in accordance with, English law. The courts of England shall have jurisdiction to hear and determine any cost, action or proceedings, and to settle any disputes which may arise out of or in connection with these rules and you irrevocably submit to the jurisdiction of such courts.
Using the service constitutes acceptance of these rules.
